Scope of Application

These General Terms and Conditions (GTC) apply to all orders and contracts concluded via the online shop balkan-babe.com (hereinafter referred to as "Provider").

By using this website and/or placing an order, customers agree to these GTC.

Offer and Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but an non-binding invitation to order.

By submitting an order, the customer makes a binding offer to conclude a purchase contract. The contract is concluded as soon as the Provider confirms the order or dispatches the goods.

Prices and Payment Terms

All prices are in Swiss Francs (CHF), unless otherwise stated.

Depending on the delivery location, additional costs such as shipping costs, customs duties, import duties, or value-added tax may apply, which are to be borne by the customer.

The available payment methods are displayed in the online shop. The Provider reserves the right to exclude certain payment methods.

Delivery and Shipping

Delivery will be made to the address provided by the customer.

Delivery times are non-binding unless expressly confirmed. Delays may particularly arise due to force majeure, supply bottlenecks, or transport problems.

With the handover of the goods to the transport company, the benefit and risk transfer to the customer, to the extent legally permissible.

Duty to Inspect and Notification of Defects

The customer is obliged to inspect the goods immediately upon receipt.

Obvious defects or deviations must be reported to the Provider in writing within [e.g., 5 days]. If no timely notification of defects is made, the goods shall be deemed approved.

Warranty

The statutory warranty provisions under Swiss law apply.

The Provider may, at its discretion, provide rectification, replacement delivery, or a reasonable price reduction. Further claims are excluded, to the extent legally permissible.

Liability

The Provider is only liable for damages resulting from intentional or gross negligent conduct.

Any liability for indirect damages, consequential damages, or lost profits is excluded, to the extent legally permissible.

Right of Withdrawal

Under Swiss law, there is generally no statutory right of withdrawal.

However, the Provider may voluntarily grant returns on a goodwill basis. The conditions for this will be regulated separately.

Intellectual Property

All content on the website balkan-babe.com, especially designs, products, images, texts, logos, and graphics, are protected by copyright and are the property of the Provider or the respective rights holders.

Any reproduction, imitation, distribution, or other use – even in extracts – without express written consent is prohibited.

Infringements, especially the copying or imitation of designs and products, will be legally prosecuted and may lead to civil and criminal consequences.

Data Protection

The protection of personal data is carried out in accordance with our Privacy Policy, which is an integral part of these GTC.

Applicable Law and Place of Jurisdiction

Swiss law applies exclusively, excluding conflict of laws provisions.

The place of jurisdiction is the domicile of the Provider, unless mandatory legal provisions dictate otherwise.

Final Provisions

Should individual provisions of these GTC be wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.

The Provider reserves the right to amend these GTC at any time.
